And it’s not the absolute degree of punishment in these cases but, rather, the differential in degree of punishment of these “moral code violation” cases from the rest. If the TMB really believes that its actions send a message to the rest of the docs in Texas by way of making examples of disciplined physicians then their message clearly is that cases of actual negligence, incompetence, and outright fraud that directly harm patients and impair health care quality will be dealt with far less harshly than”moral code violations”.
Maybe this is the type of dysfunction that could only happen in a “red state” like Texas. I don’t know. What is clear is that this kind of “church lady” type enforcement is unlikely to protect the public or stop physicians from having consensual sex with their patients any more then fining networks for profanity on TV cuts down on cursing by children. It just makes the moralists feel better.
